Intellectual Property & DMCA Policy

X LLC respects the intellectual property rights of others and expects all users of our website to do the same. It is our policy to respond promptly to legitimate claims of intellectual property infringement and to remove or disable access to infringing content in accordance with the Digital Millennium Copyright Act (DMCA) and other applicable laws.

1. Our Commitment

X LLC strictly prohibits the use of our platform and services to sell, promote, or distribute merchandise that infringes upon the intellectual property rights of any third party — including copyrights, trademarks, trade dress, and rights of publicity.

We will take appropriate action against any content or listings that we believe in good faith to infringe on the rights of others, including removal of content and, where appropriate, termination of accounts for repeat infringers.

2. Filing an Intellectual Property Complaint

If you believe that your intellectual property rights have been infringed by content on our website, please submit a written notification to our designated agent at [email protected].

Your notification must include all of the following:

1. A physical or electronic signature of the person authorized to act on behalf of the intellectual property owner.
2. The URL(s) or specific identification of the content you believe to be infringing.
3. Identification of the copyrighted work, trademark, or other intellectual property right that you claim has been infringed, including proof of ownership (such as registration certificates or other documentation).
4. Your full legal name, mailing address, telephone number, and email address.
5. A statement that you have a good-faith belief that the use of the identified material is not authorized by the rights owner, its agent, or the law.
6. A statement, made under penalty of perjury, that the information in your notification is accurate and that you are the owner of the intellectual property or are authorized to act on behalf of the owner.

3. Counter-Notice Procedure

If you believe that your content was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notice. Please be aware that if you materially misrepresent that your content is not infringing, you may be liable for damages, including legal costs and attorney's fees.

Counter-notices should be sent to [email protected] and must include:

1. Your physical or electronic signature.
2. Your full legal name, mailing address, telephone number, and email address.
3. Identification of the material that was removed and its location before removal (URL or listing reference).
4. A statement under penalty of perjury that the material was removed or disabled as a result of a mistake or misidentification.
5. Your consent to the jurisdiction of the federal court in your district (if in the U.S.), or consent to the jurisdiction of a federal court in the district where X LLC is located (if outside the U.S.).
6. Your consent to accept service of process from the party who submitted the original complaint or their agent.

Upon receipt of a valid counter-notice, we may forward it to the original complainant. If the complainant does not file a court action seeking to restrain the allegedly infringing activity within 10 business days, we may restore the removed content within 10 to 14 business days.

4. Repeat Infringer Policy

X LLC maintains a policy to track and address repeat infringement. Accounts that are found to have repeatedly violated the intellectual property rights of others will be subject to suspension or permanent termination at our sole discretion.

We reserve the right to take action against any account that acts contrary to the spirit of our Terms of Service, regardless of the number of formal complaints received.
